Free Iron & Zinc Blood Test – Terms and Conditions

Applicable to all Atta, Dal & Rice and other Better Nutrition products Subscription Plans

Please read these Terms and Conditions (Terms) carefully before availing the free Iron & Zinc Blood Test (Test) offered by Better Nutrition (Company). By scheduling or availing the Test, you agree to be bound by these Terms in their entirety.

1. ELIGIBILITY & OFFER

  1. The free Iron & Zinc Blood Test is offered exclusively to customers who have purchased and activated an active Atta, Dal & Rice subscription plan with Better Nutrition.

  2. The Test is a one-time benefit per subscription and is non-transferable, non-encashable, and cannot be clubbed with any other offer.

  3. The Company reserves the right to withdraw, modify, or suspend this offer at any time without prior notice.

2. BLOOD SAMPLE COLLECTION – CONSENT

  1. By availing this offer, the customer expressly consents to the collection of a blood sample by a trained phlebotomist (Collection Agent) appointed by the Company's diagnostic partner.

  2. The customer confirms they are above 18 years of age, or if a minor, that a parent/legal guardian has provided consent on their behalf.

  3. The customer acknowledges that sample collection will be conducted at a location of their choosing (home or designated centre) and agrees to make themselves available at the scheduled time.

  4. The customer has the right to withdraw consent at any time before collection commences. Once the sample is collected, the process cannot be reversed.

3. DISCLAIMER – BLOOD COLLECTION PROCESS

3.1 Accidents & Injuries

The Company shall not be liable for any injury, bruising, hematoma, infection, allergic reaction, dizziness, fainting, nerve damage, or any other adverse event arising during or after the blood collection process, whether or not attributable to the Collection Agent.

3.2 Medical Equipment

The Company makes no warranty regarding the syringes, needles, tubes, swabs, or any other consumables or equipment used during the sample collection process. The procurement and use of such items is the sole responsibility of the diagnostic partner. The Company shall bear no liability for any harm, infection, or complication arising from the use of such equipment.

3.3 Collection Agent Conduct

The Collection Agent is an independent contractor engaged by the Company's diagnostic partner and not an employee or agent of Better Nutrition. The Company shall not be responsible for the behavior, conduct, actions, disputes, misconduct, or omissions of the Collection Agent during or after the visit. Any grievance relating to the Collection Agent must be directed to the diagnostic partner directly. The Company disclaims all liability arising from the conduct of the Collection Agent.

3.4 Pre-existing Conditions

The customer is advised to disclose any pre-existing medical conditions, bleeding disorders, blood-borne diseases, or relevant medications to the Collection Agent prior to sample collection. Failure to do so releases the Company from any liability arising therefrom.

4. DISCLAIMER – TEST RESULTS & REPORT

4.1 Accuracy of Results

The Company does not warrant the accuracy, completeness, or reliability of the blood test report (Report). The Report is generated by the diagnostic partner's laboratory and the Company has no control over testing methodology, equipment calibration, or result interpretation.

4.2 Inaccurate Results

The Company shall not be held liable for any incorrect, false, or misleading results in the Report, including but not limited to false positives or false negatives.

4.3 Not Medical Advice

The Report and its contents do not constitute medical advice, diagnosis, or treatment. Customers are strongly advised to consult a qualified medical professional before acting on any findings in the Report.

4.4 No Consequential Liability

The Company shall not be liable for any decisions made by the customer based on the Report, including decisions relating to diet, medication, lifestyle changes, or medical treatment.

5. DATA & PRIVACY

  1. By availing the Test, the customer consents to their personal and health information (including name, age, address, and test results) being shared with the Company's diagnostic partner solely for the purpose of conducting the Test.

  2. Both the Company and its diagnostic partner are committed to handling personal data in accordance with applicable laws, including the Digital Personal Data Protection Act, 2023.

  3. The Company shall not sell or commercially exploit the customer's health data to any third party.

6. LIMITATION OF LIABILITY

  1. To the fullest extent permitted by applicable law, the Company's aggregate liability in connection with the free blood test offer shall not exceed INR 0 (zero), it being understood that the Test is offered as a complimentary value-add at no additional charge.

  2. The Company shall in no event be liable for indirect, incidental, consequential, or punitive damages of any kind arising out of or related to the Test.

7. GENERAL

  1. The Company reserves the right to substitute the free Test with a test of equivalent or greater value without prior notice.

  2. These Terms & Conditions shall be governed by the laws of India. Any disputes arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts at Lucknow, Uttar Pradesh.

  3. By proceeding to book the Test, the customer confirms they have read, understood, and accepted these Terms & Conditions in their entirety.
